Legal Question in Family Law in California

child custody and visitation. I live in northern california with 3 children currently ex has visitation 2 days per week. Next week he is moving to texas with his new wife and other kids I want to file new custody agreement, should i serve him before he leaves for texas or wait till he has "officially" moved to serve him?

There's no reason to delay serving him the request for order to change the parenting plan. It's self-evident that his relocation to Texas would produce an entirely different visitation plan than the one that you're using now. You should also consider the fact that he may have a lesser timeshare and that fact may have a direct impact upon any Child support order.
