Custody

My brother was dating a girl for a few months. He found out she was 16 and stop seeing her. He is 29. About a month later she contacted him and told him she was pregnant. He told her he would support her in whatever decision. The baby is here now, and she is now threatened him, ''If he doesn't be with her, he wont be able to see his daughter. He has been giving her $300 a month since the baby was born. Recently she cut all ties with him with the threat. He just wants to be in his daughters life, money is not an issue. Please help...He hasn't been able to sleep or work peacefully since.

Your brother needs to hire an attorney and file petition to establish a parental relationship. He will be determined to be the Father of the child and will be given custodial rights. Good Luck, Pat McCrary

Although the other attorneys are giving accurate information, they did not consider the possibility of criminal charges. Having sex with a female under 18 is a crime, penal code section 261.5. Since your brother is more than 3 younder than he is the charge could be a felony. He should not only consider taking action to establish paternity, he should contact an attorney with experience in criminal law.
