Legal Question in Family Law in California

divorce

My wife and I separated about two years ago, and never got a divorce. I have my daughter every other weekend and every Wednesday. Last year she keep giving me excuses why I could not see my child. Then she told me that she moved to Tampa for a temp job, and that she would only be down there for three months. Now she wants the divorce, and I do too. But now she says the job is not a temp job and she is staying in Tampa, and if that is the case then I want my child back in California, and do I do this in California, or Tampa? And to top it off we were married in Reno.

Re: divorce

You need to do an ex parte Order to Show Cause asking for custody here in CA immediately.

Re: divorce

California still has jurisdiction. Your wife basically hoodwinked you with child custody. Courts will likely go with the status quo, which is child lives in Tampa.
