Legal Question in Family Law in California

I have a DV restraining order against my ex husband to protect my children and myself from him being able to abuse us. We live in California and since the order was made he has hired a private investigator to watch myself and my children. Is he able to hire someone else to now stalk us

If you have a California Domestic Violence Restraining Order, one of the 'personal conduct' order provisions is that the 'restrained person' must not, amongst other things, keep the 'protected people' under surveillance. Therefore, if there is an instance where the 'restrained person' (your ex-husband) is keeping you and your children (the protected people) under surveillance, then he can be considered to have violated the domestic violence restraining order granted by the court.

I hate saying this to the wonderful customers of LawGuru but once in a while I have to just tell my true feelings. In this situation, you need to sit down with a local attorney. Contact one of the lawyers on LawGuru or wherever else. This is just to complex to answer online for you. John Molina Jr. gave his 888 number and you might try him. If you want some other info, contact me at my website at www.phillipwheelerlaw.com and just send your phone number through the contact form. We need to talk verbally or via webcam on this one.
