Legal Question in Family Law in California

Fathers personal injury settlement and child support arrears

My daughter's father is recieving a personal injury setttlement. He owes over $10,000 in back child support. Child support found his employment 4 times and issued 4 different garnishments. He quit every job a week after he discovered his wages were garnished. My question is, if I ask the court for child support through my daughters 18th birthday in one bulk payment due to his lack of comliance, will I likely get it?

Re: Fathers personal injury settlement and child support arrears

You should immediately serve the insurance company paying the personal injury settlement with a writ of attachment. You could also ask the court for a writ of attachment for future payments. with his past history of non payment and quitting his job to avoid paying child support you may be able to get the court to order that at least part of his settlement be deposited to guarantee payment of future child support.
