Legal Question in Family Law in California

My Father's "son" may not be his, can i sue him to get a DNA test and find out if he really is my brother and if he's not can i sue him so he changes his last name and pay back all the money that was given to him as child support

No. You do not have "standing" to bring any legal proceeding on this issue. Only the supposed father, the actual father if that's a different person, the child or the mother have the right to establish or contest paternity.
