Legal Question in Family Law in California

I filed for Divorce (thought it was legal separation) on 08/2011. Up until recently, I didn't realize I was being set up again as He wanted to reconcile after learning of my father's rapid decline & death in 2014. My husband is a narcissist and has taken advantage of my father's money for quite some time. Again, throughout 2014 & 10 months in 2015; he "used me" just to get access to my inheritance. 1) Is it illegal to withdraw all cash out of my account, informing me the account was overdrawn each week - asking me for more money, then I called the Bank Manager & she told me about his entire cash withdrawal is what caused me a loss of $497+ (that's minimal compared to the money he had bilked from my dad & I).

I have the Summons, Petition, Declaration (for child custody - no longer necessary), but will need spousal support asap, as well as Restitution (loan documents, elder abuse, spousal abuse) & attorney's fees since He is only one with income. My Dr. wants me to go on disability for awhile as I recover from 2 back procedures, extensive oral surgeries & healing my mind, emotions & grieving of all losses.

Can this process be completed with our Divorce? I live in Fort Bragg, Mendocino County, CA
