Legal Question in Family Law in California

My grandson is 3 1/2 and his mother is in jail for 3 years. She has told me that the man that signed the declaration of paternity is not the biological father. He lives with him and restricts me with visitation and him getting to know who his real family is. My daughter has told me who the biological father is but he is also in jail for 2 years. I need an attorney that can help with the paternity and custody. Every attorney I have spoke with has a different answer.

My daughter has given her full permission to do what ever it takes to get him, do I have a chance?

Your situation is somewhat complicated. You might consider requesting a guardianship and establishment of paternity. The concern is that the current custodial person can be considered a presumed father since he stepped into that role. Please meet with an experienced family law attorney to discuss your options..
