Legal Question in Family Law in California

My ex husband, who claims he is now homeless and jobless, says he is picking up our 3 kids Saturday. Court order from 8/13 says I am supposed to know where he lives. Court order from 8/14 says he can take them from 9:30 am to 7:30 pm. He has seen the kids 10 hours in the last 4 months. Do I have to turn kids over to him?

If your court order permits you to deny visitation because your ex has no housing, then you would not be a violation of any court order. If the orders are not that clear, you must return to court and acquire orders preventing the visitation. Please meet with an experienced family law attorney to explore your legal options.

Ms. Kock is correct. You would currently be in violation of the orders if you with hold visitation. It may be prudent to seek a temporary order until your ex get's appropriate housing.
