Legal Question in Family Law in California

My ex husband has seen our kids a total of 15 times in 5 years. He is almost $30,000 behind in child support. He doesn't call regularly, hasn't seen the kids in 3 months, and is a disruption in our kids lives. He makes promises when he does call and then backs out causing emotional damage and behavioral problems for our kids. He is also prone to packing up, quitting his jobs, and moving without any notice to his kids or family. He's moved states several times and comes back making all these promises to which he fails to keep. my now husband would like to adopt my kids since he is basically their father anyway. I don't know what to do, I've given my ex 5 years to get it together and be a consistent part of our kids lives. But it's really taking an emotional toll on our children and I need to know what I can do.

If your ex husbands behavior can be persuasive enough to suggest he has failed to support or see the children justifying an adoption, you should file and serve a request to terminate parental rights and a step parent adoption.
