Legal Question in Family Law in California

Individual credit card debt in community property state

My husband has obtained and used individual credit card accounts without my consent. Is there anything I can do in a community property state so that I cannot be held liable for his debt? We are not in the process of separating or divorcing. I am hesitant to do that because of our two children, but am worried because my husband had credit problems before our marriage (that I didn't know about until after the marriage and helped him to pay off) and he is unwilling to restrain his spending and debt to a level where I am comfortable.

Re: Individual credit card debt in community property state

With few exceptions, debts acquired during marriage are community debts and you are therefore liable.
