Married in Nevada before his divorce was final in California

We were married 10/98 in Nevada, not knowing he had a legal marriage in California. That marriage has since been legally divorced 11/02. We know that our 10/98 marriage is not legal, but do we need to annul the 10/98 marriage before re-marrying or can we just get married? Would it make a difference if we re-married in CA or NV?

Just get married any place you want. Your previous marriage was not valid but you do not need to have a judge say that it was not valid in order to perform a valid marriage ceremony. Have a good marriage. Pat McCrary

You do not need to file for annulment. Just get married again - it does not matter where you get married.
