Legal Question in Family Law in California

Married and 3 years ago, my husbands daughter was dropped off on our doorstep. The mother, has only seen her daughter 2 times in the past 3 years, and that was over 18 months ago from last contact. While she claims to family that she still wants to see her daughter, she doesn't bother to call nor has filed for visitation. There are no custody orders for his daughter. At this point we would like to petition the court for a step-parent adoption. Can we just file for the adoption or must we first gain custody of the child and then file for the adoption?

The first step would be to get interm orders for the child's sole legal and physical placement with father. Then investigate the long-term plan as a termination of parental rights and stepparent adoption. Please meet with an experienced family law attorney to explore your legal options.
