Legal Question in Family Law in California

Modification, moving from area

I currently live in Phelan, Ca and have been offered a job in Elk Grove, Ca. I have discussed it with my childs mother and she has agreed to let me move as long as we agree on a visitation schedule which for the most part has happened. Can we just get it written up and files using a paralegal or do we have to go to court. I have custody and my daugter is 11.

In a general sense, if the parents agree, a stipulation and order can be signed by the parties and submitted to the court for approval.

A paralegal could draw up the agreement. It would be better with an attorney and probably would not cost much more. I generally charge $150 to $250 to prepare a stipulated order. It is best to have and agreement signed by the parties and approved by the judge. It is highly unlikely that a judge would not approve an agreement that the parties agreed. It is probably sufficient to have just a written agreement between the two of you, but it is safer and better to have it made a court order. Good Luck, Pat McCrary
