Legal Question in Family Law in California

Move out from house after divorce

Synopsis: Divorce is final. House considered separate property in divorce, awarded to husband. Wife lives in the house but refuses to leave. Wife was notified in Nov 2006 that she had to move out by end of Jan 2007.

Is there a period of time after the divorce that she is allowed to remain in the house?

What method should be used to remove her? (eviction seems to not apply since she is not a renter, restraining order seems to not apply since it does not involve violence, although it does create a volatile situation)

Re: Move out from house after divorce

The easiest thing to do is to bring a motion in the family law court to have her move from the house. Good Luck, Pat McCrary
