Legal Question in Family Law in California

Ex has not paid court ordered health ins. and medical costs for 7 yrs for son, she has refused, I had major med. expense with his broken arm in 2 places that required surgery and many follow up appts. Med. offices were promised by her she would make payments, never did so in the interest of protecting my credit I did pay them all. My question should I again present her with court order and the monthly amount she is to pay and all past bills she owes before filing for child support modification. Reason for modification I believe she has higher income and I now have 50% custody, however modification will take some time.Again, she makes no contribution to our son's health ins. or medical, dental bills

First, if there is a change in circumstances, you can seek a change in child custody, visitation, or support. Second, with uninsured medical costs, the parent seeking repayment typically has to present the co-parent's with their part of the bill within 30 days. The other parent must then pay their share. If one parent pay more than they are supposed to, the Court can order the other parent to reimburse those costs.

You can ask the Court to determine the amount of medical costs the other parent is responsible for, especially if presenting the order and bills to the other parent will be a waste of time.
