One parent taking child significant distance away from father

My ex-girlfriend left me taking my 8 month old daughter away from me 6 counties 400 miles away. Can she do this without sole custody? Also is there a law in Ca. where she can't move more than 3 counties away?

Has paternity been established? Do you have a current court order? There are no laws that would prevent her from moving. The issue is child custody and visitation. If her move interferes with your visitation order, then it could be a problem. You really should get this matter before a judge, and fast.

She can move if there is no custody order in place. You should move quickly to obtain a custody order. There is a reasonable chance that you can get an order for her to return the child to your county. Move immediately and get a good child custody attorney. Good Luck, Pat McCrary
