Legal Question in Family Law in California

If paternity has already been established (in court) in a child support case filed by the CSSD, but the child support case is now closed, can the non-custodial parent still file a �Request for Order� requesting visitation? Or does the NCP need to open a parentage case since the child support case is now closed? A superior court case number was assigned in the child support case.

On the States website it states: �You must have an open family law case in which you can make custody and visitation requests.� But to my understanding, since we were never married the only two options I have to request visitation, are a Parentage case and through an open child support case. I�ve already established paternity and the child support case is closed. I would like to know how to go about requesting visitation. I have the Request for Order and supporting documents filled out already, I just need to know if I could use the court case # that was assigned in the child support case.

Child support services does not process or enforce child visitation or custody cases. You would have to file your own separate parentage action.
