how can i ask for a Paternity tast when i wavied my rights already in california

What do you mean when you say that you "waived your rights"?

And, how old is the child?

Both come into play as to your ability to ask for a Paternity test.

Also, is there a judgment of Paternity which has already been entered?

I agree with Mr. Schneider. The answer is going to depend on how you waived your rights, such as signing a Voluntary Declaration of Paternity, and the precise chronology of events.
