Legal Question in Family Law in California

I am respondent in legal separation filed May 2012 in Contra Costa County California and I was served January 2013. If I file for divorce first, do I become the petitioner?

No. The proper procedure is to file to convert the legal separation to a divorce. You would remain designated "Respondent." It makes absolutely zero difference which spouse is the petitioner and which is the respondent as far as anything to do with how the case will proceed beyond the initial filings or how anything will be decided in the case. So don't worry about it.
