Legal Question in Family Law in California

spousal support

How do you prove standard of living during a long term

marriage?

My husband filed a motion to terminate spousal support.

Went to court and the Judge said she could not make a decision until she knew what the standard of living was during the marriage.

Married in 1980, Divorced in 1997.

I worked for the same company for 13 years and was laid off when the company was sold in 1991. So I worked part-time with my ex husband. He is a supervisor of a gated community and a worked in the landscaping dept.I had the winters off unless my ex needed help with snow removal than I worked.

We were given a beautifeul home to live in. The house was part of his work package and was free of rent, utilities, snow removal etc.

We moved in early 1985 and I moved out in Jan. 1997 he still lives there.

We bought a house in 1987 as a rental. I moved into that house and paid him off his accepted share with a refinance after the divorce.

I have worked full time since the divorce but live paycheck to paycheck. I have a daughter in college. And I am trying to be self supporting but without the spousal support I would sink.

What do I need to do for the court hearing to prove standard of living and needing the support that I now recieve.

Re: spousal support

Spousal support is based on a number of factors. That is your need, and his ability to pay. The standard of living is a factor to be considered in determining your need. Pictures of the home in which you live and other factors which you can testify to can show standard of living.
