Legal Question in Family Law in California

Statute of Limitations on Divorce Settlement?

Is there a statute of limitations on a property setllement in a divorce settlement? I divorced in 1992. Ex-Spouse was ordered to buy me out of our property for $50,000., and has not. Can I take him to court to have the judge enforce the order?

You need to take you judgment to an attorney who can give you good legal advice after reviewing the documents. Normally, a money judgment must be renewed before ten years or it becomes unenforceable. Don't wait but handle this immediately. Depending upon the wording you may still be able to enforce the judgment. If you want to fax me a copy of the judgment I can give you a quick evaluation. I received a copy of your judgment and have reviewed it. It looks like you still have rights that are substantial. Your fax did not give me a telephone number to call and I have a couple of questions. Please call or fax my office. You can call 800-FAM-LAW5, if I am not available I will call back. Pat McCrary
