You would have to file a petition for stepparent adoption, a copy of which goes to the county. It will then charge you a few hundred dollars for a background check, and if all is OK will approve it, then you set a court date and that's it. Your husband will have all the rights but also all the duties of a birthparent, including child support if you divorce, and your daughter will have all the rights of any child, including inheritance and rights to social security benefits as a survivor until she is an adult.

This response is a supplement to the other two replies.

If your daughter is presently receiving survivor benefits from Social Security, those benefits would cease upon the adoption.

Since the father is deceased you would not have to get any other consents than your own and your daughters since she is over12. Your husbanc may have to pay an investigation fee to the state based on a sliding scale.
