Legal Question in Medical Leave in California

Child Care needs after FMLA

I have an employee who has been out of work for 17 weeks due to pregnancy/birth. She has been medically cleared to return to work but has been unable to find a babysitter to take her two children AND a newborn. Taking into account her medical clearance as well as the ''bonding'' time required in California, for how much longer do I have to guarantee her position?

In general, FMLA provides 12 weeks medical leave to qualified employees, and the Pregnancy act allows 4 months bonding time. YOu should consult with counsel before making any decisions or demands upon her, to avoid costly mistakes.
