Legal Question in Medical Leave in California

Paid and Unpaid Maternity Leave Provided in California

I am quite familiar with the FMLA and the 12-weeks of unpaid leave that it allows. I have heard that there is California law that allows for 6 weeks of PAID maternity leave. However, I have been unable to find any details about this law or whether it really exists. Also, if it is for real, is the 6 weeks paid in addition to, or part of, the 12 weeks of unpaid leave from FMLA?

Check California Laws

Mr. Posner, please check with an attorney in California about the California laws. I am an attorney in Georgia. I could only answer related questions if they concern FMLA, but not specific California laws.

Re: Paid and Unpaid Maternity Leave Provided in California

I don't know of any requirement for paid leave. It's unpaid, unless the company pays everyone for disabilty leave, which is what pregnancy is, and to require an employee to use up vacation, etc, if the employee wants to get paid. If you don't have have any vacation accrued, the leave is un paid.
