Legal Question in Civil Litigation in California

I hit a horse on a dark country rode the horse was killed the rider broke her wrist, she had no reflective clothing and the police report said it was her fault. They talked to two, that I know of,news stations and broadcast that I was speeding and drunk driving which neither were true, I am well known in the community and worked at the local school for years ,I had parents of children i have known for years coming to my place of employment asking me why I was driving drunk and speeding. This has been a financial burden getting a new truck , I have been unable to drive because I'm paraniod and have been extremely embarrased by the news broadcast. I am asking can I seek damages to compensate for my financial hardship. Also do you have names of lawyers that might be interested in this case.

You should consult with several personal injury attorneys in your area. You should be able to sue for damage to your vehicle. The false statements being made about you may also have some value. A through review of the facts by your attorney will be required to determine your options.

It sounds like you have a decent defamation case, assuming there is admissible evidence of everything you've said. The stations that broadcast the defamation may be liable as well. At a minimum, if it was her fault, she would be liable for the damage to your truck and loss of use until you got another one. I would be happy to talk to you about taking your case. Against news media, you are fighting an uphill battle trying to sue for slander, since they have certain immunities and will defend by saying they were quoting reliable sources. You might have a better case against private individuals who you can prove 'knowingly' made false statements. These situations are never 'great' cases. Consult with a local specialist attorney.
