Negligence

My ex wife signed a agreement to transfer the remaining money she owed me from our divorce settlement (been divorced over two years) within a specific timeframe. That date came and went. I have incurred several thousand in attorney fees trying to get her to perform her agreed upon task. Can I sue in in civil court for negligence ?
