Legal Question in Civil Litigation in California

Hello, I have person who is going to sue me, but I also want to take out a restraining order how will that help my case? Should I proceed to let him sue me and not take on a civil restraining order?

You haven't told us enough about your situation. The other person's potential lawsuit and your potential restraining order case might or might not affect one another. A restraining order almost certainly would not prevent the other person from suing you, if that's what you have in mind. Similarly, you should be just as able to seek a restraining order after you are sued as you are now.

I would just add that getting a restraining order does not prevent you from being sued, or create any legal defense in your favor.
