Is there statutory authority in California to apply post judgment payments first to interest, then to principal?

Legal Answer


Yes. Generally Code of Civil Procedure Section 685 deals with calculating interest. However, it is also standard under any loan (a home loan, a credit card) that payments go first to interest and then applied to reduce principal.
