How can my brother ask for a perdon to be able to come back to the USA legally once he got voluntary deportation

There is no voluntary deportation. There is a stipulated order of removal if an alien agrees he is subject to removal for violating the Immigration and Nationality Act. That alien must also waive all applications for relief from removal as well and must sign the stipulated order which is then presented to an Immigration Judge for his/her signature. You might mean voluntary departure which is different than deportation. Deportation (removal) triggers a bar to returning to the U.S. Aliens afforded voluntary departure are not barred from the U.S. for being ordered deported. They may be barred for other reasons. You and your brother should hire an immigration lawyer who will review the case in its entirety and determine the best course of action to returning to the U.S.
