Legal Question in Immigration Law in California

I am a US citizen residency in MA, currently living in Hong Kong, got married in 2010 in HK and now we would like to move to US but in CA, how could I apply citizenship for my husband? Thanks.

You theoretically could petition your husband for a greencard (not citizenship). However, you must be domiciled in the United States in order to do so. If you have lived in Hong Kong for the past 4 years, you would need to re-establish domicile in the U.S. first (while your spouse remained in Hong Kong). You would also probably need a co-sponsor for the Affidavit of Support.

Your spouse would then need to apply for his immigrant visa at the U.S. Consulate, since he cannot enter the U.S. as a visitor, now that he has immigrant intent.

Good luck!
