Legal Question in Immigration Law in California

consular notification upon 7th year extension - why?

Hi,

I'm in my 7th year in US. My 7th year H1 extension was approved recently with a remark 'consular notification required'. My attoney says that NSC has made an error in this case or otherwise I have to go out of the country and get a stamping. Currently we are in the process of sending a letter back to NSC for correction.

Is this true that a consular notification and stamping aboard is mandatory. Can NSC be true in any case. If NSC is true, can I get stamping (H1b revalidation) in Canada?

Is it wise to ask NSC to correct their error?

Please advise.

Thanks.

It is possible to go to a third country consulate to get your visa stamped. It is also likely that NSC made an error in requiring you to go out of the country.

I would advise you to follow your attoney's advice and see if NSC corrects the approval.
