Legal Question in Immigration Law in California

Hi

I am a high school senior with an H4 visa who is currently in the process of obtaining a green card. I want to leave the US and return as a parolee so I can qualify for college financial aid. My visa is valid and stamped but when I was 15 I was arrested on shoplifting charges. The items were valued $100 at the most, and we hired an attorney who arranged it so that I would not have to appear in court. I believe the issue was deferred and the charges were dropped. I spent no jail time and was not even required to take classes or do community service. I think my family just paid a fine. Will this affect whether or not I can reenter the US?

The juvenile misdemeanor theoretically should not affect your ability to re-enter on advance parole. However, you just never know how Customs & Borden Protection will react to your re-entry under the circumstances. It would be preferable if you waited until you adjust status. I suggest you also consult with the immigration attorney who may have assisted your family with the immigrant visa case.
