Legal Question in Immigration Law in California

Hi All,

I plan on traveling to mexico in mid dec for about a week. My current h1b stamp and i-94 is valid till Early Jan. My extension has been applied but i do not think i will get the approval by the time i travel.

is there any concern to travel out of the country with such less time left on visa stamp and ext in progress? Please Advice

CBP could hassle you on the way in, however, with a passport that is valid for at least 6 mos + a valid H-1B visa in your passport+ your current I-129 approval notice + your I-129 extension of stay receipt notice, you should be ok. Remember to bring all of those documents with you. A current pay stub or letter from your employer couldn't hurt, either, although you probably won't need it. I always encourage people to be over prepared, b/c you never know what kind of Officer is going to admit you & some can be nasty.
