Legal Question in Immigration Law in California

My wife filed on my behalf on Sept 2010, we had an interview on Dec 2010. The case was on review after that. On April 2012 we got denial stating that we never responded to a Notice of intent to deny which was sent on Feb 2012. Actually we never received such a notice and we did't even get USCIS case status email.

We filed MOTR last week and it was said that it can take up to 6 months. We also called USCIS reading that they are opening cases which is affected by administrative error for certain categories. But the lady just made it as service request and they did't review anything and sent us a copy of NOID without reopening the case. We are curious to see if there is any other remedy to expedite the case, like an infopass appointment and letting them know our hardship.

45 days after the service request, you can schedule an Infopass appointment.

Motions to Reopen/Reconsider & Appeals can take up to one year.

There is always a remedy in Federal Court, but it is costly and you will need to hire an Immigration Attorney.
