Car accident, not my fault

In July 2007 I hit a van truck who pulled out onto the freeway from a stop sign. I hit him doing 55 mph with my five year in the car. This totalled my car and sent my daughter and I to the hospital. My daughter is fine, but I have a sprained shoulder and this has agravated a pre-existing injury in my lower arm. My daughter and my medical bills are already in the $20K. I have two jobs, one I missed for two weeks and the other they are not sure if I will be able to return to because it is waitressing. The at fault drivers insurance company is saying I have a ''good claim.''

A friend told me I am entitled to 3X the medical expenses. Is this true?

Should I get an attorney, or is this something I can do myself? I am lost and not sure what to do?

Don't ever think you'll get fairly treated by an insurance company if you do it yourself. Insurance companies know that the injured person often is easily persuaded to accept a low-ball offer. It sounds like the driver and his employer were negligent. Get yourself an attorney to negotiate this for you so that your medical bills and pain and suffering are adequately compensated.

The insurance company will put a lot of hurdles in front of you to lower the value of your claim. They typically argue you may have over-treated, or you may be partially at fault or they make a low offer due to your pre-existing condition.
