Legal Question in Insurance Law in California

Hi,

I have a question, if I am a private bus driver and I had a passenger hurt in the bus due to someone else, am I reliable? Example, I breaked hard to prevent an accident that someone else caused due to not following the right of way rules and one of my passengers got hurt. I have a video of the car crossing in front but don�t know his identity or license plate number. I cant prove who it is but that it is someone else that I don�t know. In that case, if I am sued will I win the case?

You might be. Immediately turn this in to your insurer. You are a common carrier, and the duty to care for your passengers is much higher than normal. Did your seats have safety belts?

Were you partially at fault for driving too fast causing your hard braking, what lane were you in, etc. Too many factual questions need to be answered to determine if you might be liable.

And some research is needed concerning your common carrier status. Your insurer should protect you though. And if you don't have insurance then you must seek out a knowledgeable lawyer. Good luck.
