Legal Question in Intellectual Property in California

Is Permission Needed?

My company produces resume tapes for people trying to become tv reporters. I video tape them reporting news. I often post pictures of my successful graduates on my website.. I posted a picture of a successful graduate who is now asking me to take it off my sight. I created the picture and the resume tape. She's threatening to sue if I don't take it down. Does she have a case?

Re: Is Permission Needed?

Yup. Take it down. She's got the right to control the use of her name and likeness. (The Right of Publicity).

From now on, you'll want to get a signed release for such uses when you agree to produce their demo tapes.
