Legal Question in Employment Law in California

My brother had a stroke at work and instead of calling 911, they sent him home. It was obvious to his supervisor he was unable to communicate his problem. Do they have any responsibility to have called 911 and obtain medical help for him?

Yes and employer are more likely to be held liable if the stroke is some what work-related . For example if the work condition (such as job pressure or a traumatic event) caused his stroke, then he can even claim a worker's compensation injury due to his work. Possibly, if he can show the lack of prompt medical care damaged him. I would rate that as quite likely.

He may also have a Workers Comp claim for the medical issues. He needs to consult with comp counsel.
