If you are out with co-workers celebrating a birthday after hours in California is it legal for the company to write you up for anything said<

"Legal"?

For starters, you need to understand that not only are there no laws against poor management, 'unfair treatment', or rude, obnoxious or harassing behavior by management or other employees, but in general, unless an employee is civil service, in a union, or has a written employment contract, they are an 'at will' employee that can be disciplined or terminated any time for any reason, with or without �cause�, explanation or notice.

You also need to understand that anything you do or say in public can and will be used against you, such as insulting, badmouthing or slandering the company or other employees, whether at a bar, on on social media like FaceBook, etc.
