Legal Question in Employment Law in California

Can my employer terminate me without pay after working for 14 days? We have a contract for 6 months. They are supposed to pay every 15 days. Can 1 day make a difference?

Your question raises two questions really, can the terminate you without paying you at all, because you didn't make it to 15 days, and can they terminate you before the 6 months are up.

The answer to the first question is absolutely "no." They have to pay you upon termination for all work prior to the termination. Not must they pay you for whatever time you worked, if they don't pay you on the day they terminate you, you get an extra day's pay for every day between when they were supposed to give you your termination paycheck and when they actually pay you, up to 30 days.

The answer to the second is not so easy to answer. It would depend on the terms of your contract and whether they had just cause. you would need to have a lawyer look at the contract and go over the details of your termination in order to get an answer to that part of the question.
