Legal Question in Employment Law in California

Am I entitled to unpaid sales commissions closed prior to my leaving the company?

When I started at the company we signed a Employment Contract that had the following language in it: If for any reason you are terminated or decide to discontinue your employment with ____, you will not be entitled to any additional commissions after youve left the company. Commissions are paid after a candidate has been placed and remains at their new position for a minimum of thirty (30) days of employment which is referred to as the Guaranty Period.

Our contracts with the other companies guarantee the new hire will complete the probation period (anywhere from 30-180 days) in order for us to receive full funds. Once a candidate has accepted a position we typically have to wait 30 days or so for them to start their job, then we bill the hospital net 10 or net 30

Probably. You will need to take your agreement to a local employment attorney for a consultation.
