Sue him in small claims court or file a claim with the California Labor Commissioner, Division of Labor Standards Enforcement.

You can sue in Small Claims Court, but you have to represent yourself. Or, you can file a claim with the Labor Commissioner. Or better yet, have an employment law attorney write a demand letter asserting your right to wages plus any applicable waiting time penalties (up to 30 day's pay) and if you were an employee and not an indep. contractor, the law states that your employer "shall" pay your attorneys' fees (but not if you file a Labor Commissioner Claim or a Small Claims Court lawsuit.
