temporary disability

How long does an employer have to keep a position open for and employee who injured herself at home, not workers comp and now is applying for state disability?

If both you and your employer qualify for Family Medical Leave Act/California Family Rights Act (FMLA/CFRA) coverage, your employer must return you to your same or substantially similar position if you return within 12 weeks. To qualify, you must have worked for the employer for over one year, and have worked at least 1250 hours within the last 12 months. Your employer must have 50 or more employees within a 75 mile radius to your worksite.
