Legal Question in Employment Law in California

unemployment insurance eligibility due to job performance

I was recently told during an evaluation that I needed to do better and was offered a choice of remaining on an improvement plan, or resigning. I was told that if I resigned, HR would say that I left ''by mutual agreement''. Will I be ineligible for UI in California if I accept my ''forced resignation''?

Yes. If you resign, you will not be eligible for unemployment insurance benefits under Unemployment Insurance Code.
