Wrongful Termination

I work for San Manuel Indian Bingo & Casino located in Highland, CA. I have been with the company for 10 years. Recently I sent out an email to the Tribal Members regarding issues with my department and how I was being unfairly treated. Well now I�m on paid suspension and they want me to sign a last chance agreement before I�m allowed to return to work or face termination. I have never been written up or discipline in my 10 years of employment. If I do get terminated do I have a good case of wrongful termination?

I could answer you for anywhere in CA...except on tribal land. There are very specific tribal laws. I suggest contacting the Departmet of Labor. They may be able to direct you to an apporpriate tribal law attorney. I could research the issue for you, but it would probably not wind up being the most cost effective for you.

You work for a foreign nation, whose own laws, rules and contract terms determine your rights. Good luck. Some of the CA employment and labor laws may apply, but even if they all did, that would simply mean you are an 'at will' employee that can be fired for any reason. Do you have a case? No, you haven't stated anything illegal. Unfair is not illegal, and this may not even be 'unfair'. You publicly criticized your employer; sounds like misconduct. Nobody said life was fair.
