Legal Question in Landlord & Tenant Law in California

Evication notice (3 day notice)

I was informed by landord son's who collect the rent that I am 3months behind in rent. According to my receipts from april 2005 to august 2005 I would be only $625.00 short. but my husband had a verbal agreement with the landlady starting in May or rent would only be 500.00 which would then put me at 325.00 behind and he also had a verbal agreement with the Guadalupe her son the since he trimed the tree in the front no rent was due in June. so this would now put me at being ahead by $275.00. But my husband is being detained and all verbal agreements our out the window. I received 3 day notice on 8/30/05 to leave. what can I do to fight this. do I have a chance ?????

Try to create a payment plan -- in writing -- with the landlord, even if you could buy a month or two more. If that doesn't work, the landlord next will file an unlawful detainer lawsuit against you, which will take 2-3 weeks to go to trial if you answer the lawsuit and give you time to find a place during that period. However, the unlawful detainer will be recorded on the UD Registry and make it a lot more difficult to find a new place, and especially if you don't have money for a downpayment.
