Eviction

I am living in an apartment that is in my fathers name and the rent is late. the property management company left a letter stating that the rent would need to be paid and if it was late again they would serve a 60 day notice. Well 5 days later they left eviction papers with my 17 year old daughter. I called and the rep said she could not accept the rent and that I would need to call their attorney. I am going to move out right away but I don't want my father to have a problem, what can we do.

The landlord has a right to evict a tenant who does not pay rent. It sounds like they served eviction papers 5 days later after not hearing from you (never ignore or delay on these kinds of things).

If you would like to hire me to contact the landlord attorney and try to negotiate something, please contact me directly. Among other things, I would need to review your lease, tenant rules, the letter, any prior documentation on any problems (not just late rent), and discuss with you and your father all the facts. If your father has been in the apartment a long time, this is the first problem and there is a good reason you failed to respond to the letter, then a resolution can probably be reached.
