Legal Question in Landlord & Tenant Law in California

Hi,

I was supposed to give two months notice of a plan to move out on a current lease. This is back in December. Instead, I moved out in one month and arranged to have a new tenant pick up the lease for the second month, February. All the arrangements were made--I found a new tenant and got them in touch with the landlord. However, instead of putting the tenant in the apartment I was showing, the landlord put the tenant in a different unit. The unit I was moving out of was cleaned and ready to be inspected by the landlord. He was given notice of our intent to leave, find a new tenant and he was notified of when we had turned in our keys. A week later he tells me that one set of lights do not work and another set is out. The set that is out was reported on many times, but nothing was ever done about it and the set that "doesn't work," worked fine when I left.

My question is, if I found a new tenant to take over my lease for February but the landlord places the tenant in a different unit, am I still responsible for the remainder of my lease? What rights do I have if a landlord does not repair basic needs such as lights in an apartment with high ceilings?

It sounds like you and the landlord reached agreement on a change to the written lease. However, the change did not go according to plan. I suggest that you contact an attorney so that all of the facts and documents can be reviewed so that you can be properly informed of your rights. I direct you to our website at www.higagipsonllp.com and contact me for an initial consultation.
