Legal Question in Landlord & Tenant Law in California

live in California I'm staying with a person that I have a written agreement for partial rent of 600.00 I am not on the lease and her landlord does not know I've been living there for over a year. ( did not know that she did not contact her landlord.) She wants me out in 60 days and has been black mailing me to pay half of the rent and utilities. This is been going on for a year. What is my recoarse and do I have to pay more than what the written agreement is for ?

It depends on what your lease says. If your lease was for one year, and no new lease was signed, then you are considered a month to month tenant. Since you have been there for more than a year, she can ask you to leave but must give you 60 days notice. I am not sure what you mean by blackmail. If you live there, you are obligated to pay rent. A review of the agreement would be required to give you a complete answer. It seems that she wants you out, maybe you can work something out with her - a reduction in rent if you leave sooner? No rent if you leave in 30 days? Talk to a local landlord tenant attorney.
